Patents, trade marks and registered designs all require occasional payments of official renewal fees to maintain them in force and, since this is a routine administrative matter, Withers & Rogers Renewals LLP (W&R Renewals) is established to pay renewal fees. W&R Renewals will send reminders of upcoming renewal fees to our clients, and on the instructions of our clients will pay the renewal fees and issue an invoice for the renewals work.
W&R Renewals is a separate but related business to Withers & Rogers LLP. W&R Renewals' services are available to all clients of Withers & Rogers LLP as well as anyone else who wishes to use them.
Our Renewals service includes:
Up to three reminders of renewals due including cost estimates
Payment of renewals on client instructions
Payment of UKIPO, OHIM and EPO renewal fees on behalf of other renewals agencies
Gathering evidence of use in support of trade mark renewals
If you are not already a client of W&R Renewals and wish to engage our services, please contact us and we shall take you through our engagement process.
Once you receive a renewal reminder notice from us, please review it carefully, and decide whether you wish to renew the cases listed in the reminder. To make it as easy as possible to instruct us, the list of renewals includes boxes which can be marked to indicate your instructions, and a space at the bottom for you to sign. Simply fill in the instructions and return it with your payment for the renewal fees to be paid.
You should understand that responsibility for paying renewal fees rests with the owner of any intellectual property. This is a responsibility which is derived both from legislation and from decisions issued by patent offices where applications have been made to restore cases which have lapsed through a failure to pay renewal fees. Consequently, in addition to relying on renewal fee reminders from us, it is important for you to diary renewal dates as well. Withers & Rogers Renewals LLP will normally notify you of these once it is known when they will fall due.
Finally, please be aware that, if a renewal fee is not paid in time, the case will lapse and your rights will be lost.
