Intellectual Property Law is an all encompassing phrase that refers to a number of distinct types of creations of the mind for which a set of exclusive rights are recognised under the corresponding fields of law. Intellectual property law exists to protect your interests and to ensure that your inventions, artistic works and designs are not used without your permission. The term intellectual property law includes many very different, unrelated legal concepts
An intellectual property attorney works to protect intangible assets that are the product of human activity, for example inventions, designs or literary or artistic works. In the case of inventions, an intellectual property attorney advises on whether it may be possible to obtain a patent, prepares and files patent applications and processes them through to grant. An intellectual property attorney may also become involved in advising in patent infringement proceedings, either on the side of the claimant or the defendant.
In the case of designs or literary or artistic works, an intellectual property attorney may advise on copyright ownership and infringement in relation to literary or artistic works, or registered designs or unregistered design rights in relation to the appearance of a product. This may include filing and prosecution of registered design applications and advising the claimant or defendant in infringement proceedings.
An intellectual property attorney may also help protect new brands by providing advice on trade marks and filing and processing of trade mark applications to registration. In some instances, an intellectual property attorney advises in trade mark infringement proceedings, acting either for the proprietor in defence of registered trade mark rights or for a defendant accused of infringement of such rights.
